Next Tuesday, Florida Republican Representative David Weldon, with the support of the National Right to Life Committee, will introduce the Incapacitated Person’s Legal Protection Act, a bill that would give the parents of Terri Schiavo the opportunity to argue their case in a federal court. Referring to the use of the writ of habeus corpus to override decisions made in state courts, the bill would allow for federal courts to take over “cases like Terri’s” if they didn’t like the way states were handling them. If the combination of Weldon’s name and the National Right to Life Committee sounds familiar, it’s probably due to their last bit of joint-sponsored legislation: the back-door addition of a sweeping anti-abortion clause to last November’s must-pass omnibus spending bill. Because, hey: when you think you’re right, why bother with following legal procedure?
