Attorneys for President Bush have asked the U.S. District Court in Washington, D.C. to dismiss Michael Newdow’s lawsuit attempting to bar official Christian prayers at the presidential inauguration, saying the lawsuit is a “recycled case” — Newdow filed a similar suit four years ago — “about an issue that does not violate the U.S. Constitution.” The American Center for Law and Justice has also opposed Newdow’s lawsuit as “legally flawed,” and has filed an amicus brief in support of the Department of Justice’s defense. And the conservative hoi polloi at MichNews couldn’t be more pleased to see their trusty adversary back in the frey. As usual though, they could be more accurate about the facts of the story.
